Court records indicate that a 68-year-old man from Northern Kentucky has been arrested on a rape charge. Kenton County Commonwealth Attorney Rob Sanders stated that Robert Denham informed Villa Hills police he had sexual relations with the victim while she was “unconscious.”

Denham was arrested on Tuesday and is currently at the Kenton County Detention Center, held on a $100,000 bond. The case goes back to court next week for a preliminary hearing.

 Villa Hills police responded to Denham’s residence in the 2400 block of Horton Street shortly after noon on Tuesday after receiving a report of an unresponsive individual there, according to court records filed Wednesday.

Officers found a woman unresponsive and unable to communicate, according to his arrest citation.

 Paramedics transported her to St. Elizabeth Edgewood, where the nursing staff informed police, “The victim was placed on a ventilator and is in serious condition, most likely due to an overdose,” according to the court filing.

Medical staff also informed the police that she was labeled a “ Jane Doe” due to the lack of information regarding her identity.

 Sanders stated that investigators know her identity and are continuing their investigation.

He said they have not been able to interview her because she is on a ventilator or has received the toxicology report.

 “First of all, we don’t know for sure that it was a drug overdose,” Sanders said. “It simply seemed to be a condition resembling a drug overdose.”

Denham’s arrest citation alleges that he informed the police he picked up the woman in Cincinnati on Monday and took her to his home, where she stayed overnight.

 Police reported that Denham claimed he woke up beside her at 6 a.m. Tuesday and had sex with her, stating that she had not been awake since he spoke with her around 11 p.m. the previous night.

 According to the arrest citation, Denham told police “while he was having sexual intercourse with the victim, she did not move, was dead weight, was not speaking and appeared to be incoherent“ and “the victim had snot or other liquid coming from her nose and mouth while he was having sexual intercourse with her.” Denham reportedly told the police “multiple times that the victim was incoherent when he was having sex with her.”

 The court filing states that she “fell off the bed, was dead weight, and (he) had trouble lifting the non-responsive victim from the floor” after he got up to go to the bathroom, prompting him to ask his cousin for help in lifting her back into bed.

Denham’s cousin told him that " the victim was not breathing correctly and he needed to call 911,” according to the court record.

 Sanders stated that additional charges could be filed, depending on the woman’s condition and the findings of the ongoing investigation.

 “If we find out what happened to her and how she came to be in this state, whether it involves drugs or not, by his own admission, according to the arrest citation, there was a great delay in calling for emergency medical help,” Sanders said.

 Right now authorities don’t know if more victims are out there but say it is possible.
