Jessica Terry, 44, of Mount Sterling, KY appeared before Judge Henria Bailey-Lewis in District Court for arraignment in Case #25-F-00121. Terry was arrested by JCSO Deputy A. Brewer on October 18, 2025 after he was dispatched to the Dollar General Store in Sand Gap, KY in response to an alleged domestic situation.
According to Uniform Citation #EU58814, upon arrival and speaking with Ms. Terry he noticed the smell of an alcoholic beverage emanating from her person. While she was looking for her ID, Deputy Brewer noticed a Mike’s Hard Lemonade in the driver’s door cup holder. When asked if she had been drinking, Terry’s first response was, “Can I just call my Mom to come get us?”. However, when asked again she replied that she had been drinking earlier.
Deputy Brewer administered a series of Standard Field Sobriety Tests and, based on the results of those tests, placed her under arrest. Subsequent to the arrest a search of the vehicle was conducted. Inside the driver’s side door cup holder was a Mike’s Hard Lemonade that was half empty and still cold to the touch. In the center console area was an empty Margaritaville Silver Shot. In the driver’s floor was a BuzzBall Biggies Tequilla Rita that was 2/3’s empty. Under the driver’s seat was an empty Johnny Bootleggers Iced Lemonade.
While searching the vehicle, Deputy Brewer reported that the children made the spontaneous utterance that “Mommy drinks adult drinks all the time while she drives.”
DCBS was notified about the children in the vehicle and Special Deputy Evans stayed with them until Child Services arrived. Terry was transported to the Jackson County Detention Center where she was read “implied consent”. However, Terry refused to contact an attorney and refused to perform a breath test.
Terry was charged with operating a motor vehicle under the influence of alcohol, 1st offense, possession of an open alcoholic beverage container in a motor vehicle, and four counts of wanton endangerment, 1st degree.
At the arraignment on Monday, Terry entered pleas of not guilty to all the charges. Judge Bailey-Lewis entered an order for pretrial suspension of Terry’s operator’s license, bail credit was denied, and Terry should be considered a danger to herself or others.
A preliminary hearing was scheduled for October 27, 2025.
As in all cases at this stage of adjudication, the defendant is presumed innocent until provided due process and determined to be guilty by the court.
